{"id":1324,"date":"2024-04-10T08:58:04","date_gmt":"2024-04-10T08:58:04","guid":{"rendered":"https:\/\/www.youthclic.hk\/?post_type=topic&#038;p=1324"},"modified":"2024-04-10T08:58:15","modified_gmt":"2024-04-10T08:58:15","slug":"jurisdiction-of-the-juvenile-court","status":"publish","type":"topic","link":"https:\/\/www.youthclic.hk\/en\/topic\/our-legal-system\/juvenile-court\/jurisdiction-of-the-juvenile-court\/","title":{"rendered":"Jurisdiction of the Juvenile Court"},"content":{"rendered":"\n<p>Offenders below the age of 16 are dealt with under the&nbsp;<a target=\"_blank\" href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/226\/\" rel=\"noreferrer noopener\">Juvenile Offenders Ordinance<\/a>&nbsp;(<a target=\"_blank\" href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/226\/\" rel=\"noreferrer noopener\">Chapter 226<\/a>) which restricts punishment on children and young persons.<\/p>\n\n\n\n<p>According to&nbsp;<a target=\"_blank\" href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/226\/s3a.html\" rel=\"noreferrer noopener\">section 3A<\/a>&nbsp;of the&nbsp;<a target=\"_blank\" href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/226\/\" rel=\"noreferrer noopener\">Juvenile Offenders Ordinance<\/a>, the juvenile court consists of a permanent magistrate, and has the jurisdiction to hear and determine any charge against a \u201cchild\u201d or \u201cyoung person\u201d of any offence other than homicide.<\/p>\n\n\n\n<p>\u201cChild\u201d is defined as a person under 14 years of age.<\/p>\n\n\n\n<p>\u201cYoung person\u201d is defined as a person aged 14 years and under the age of 16 years.<\/p>\n\n\n\n<p>It should also be noted that no child under the age of 10 can be guilty of a criminal offence. However they may be subject to care and protection proceedings as pursuant to&nbsp;<a target=\"_blank\" href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/213\/\" rel=\"noreferrer noopener\">Protection of Women and Juveniles Ordinance<\/a>&nbsp;(<a target=\"_blank\" href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/213\/\" rel=\"noreferrer noopener\">Chapter 213<\/a>).<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Offenders below the age of 16 are dealt with under the&nbsp;Juvenile Offenders Ordinance&nbsp;(Chapter 226) which restricts punishment on children and young persons.
