{"id":1363,"date":"2024-04-10T09:30:05","date_gmt":"2024-04-10T09:30:05","guid":{"rendered":"https:\/\/www.youthclic.hk\/?post_type=topic&#038;p=1363"},"modified":"2024-04-10T09:30:31","modified_gmt":"2024-04-10T09:30:31","slug":"stopping-and-questioning-by-the-police-in-a-public-place","status":"publish","type":"topic","link":"https:\/\/www.youthclic.hk\/en\/topic\/our-legal-system\/arresting-procedure-my-rights-and-obligations\/stopping-and-questioning-by-the-police-in-a-public-place\/","title":{"rendered":"Stopping and questioning by the police in a public place"},"content":{"rendered":"\n<p>Under&nbsp;<a target=\"_blank\" href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/232\/s54.html\" rel=\"noreferrer noopener\">Section 54(1)<\/a>&nbsp;of the&nbsp;<a target=\"_blank\" href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/232\/\" rel=\"noreferrer noopener\">Police Force Ordinance<\/a>&nbsp;(<a target=\"_blank\" href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/232\/\" rel=\"noreferrer noopener\">Chapter 232<\/a>), it is lawful for a police officer to stop a person who is acting in a suspicious manner. The police officer may require that person to produce proof of identity (i.e. by showing a Hong Kong ID card or passport), and detain that person on the spot for a reasonable period to make enquiries into whether or not the person is suspected of having committed any offence at any time. What constitutes a &#8220;suspicious manner&#8221; is based only on the subjective assessment of the police officer. However, the police officer must, in fact, have a genuine suspicion.<\/p>\n\n\n\n<p><a target=\"_blank\" href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/245\/s49.html\" rel=\"noreferrer noopener\">Section 49<\/a>&nbsp;of the&nbsp;<a target=\"_blank\" href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/245\/\" rel=\"noreferrer noopener\">Public Order Ordinance<\/a>&nbsp;(<a target=\"_blank\" href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/245\/\" rel=\"noreferrer noopener\">Chapter 245<\/a>) permits a police officer to require any person to produce proof of his identity for inspection for the purpose of preventing, detecting or investigating any offence. A failure by that person to produce proof of identity under these circumstances constitutes an offence.<\/p>\n\n\n\n<p>The police and immigration officers also have power under&nbsp;<a target=\"_blank\" href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/115\/s17c.html\" rel=\"noreferrer noopener\">Section 17C(2)<\/a>&nbsp;of the&nbsp;<a target=\"_blank\" href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/115\/\" rel=\"noreferrer noopener\">Immigration Ordinance<\/a>&nbsp;(<a target=\"_blank\" href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/115\/\" rel=\"noreferrer noopener\">Chapter 115<\/a>) to demand any resident in Hong Kong aged 15 or above to produce proof of his identity for inspection.
