{"id":1366,"date":"2024-04-10T09:31:28","date_gmt":"2024-04-10T09:31:28","guid":{"rendered":"https:\/\/www.youthclic.hk\/?post_type=topic&#038;p=1366"},"modified":"2024-04-10T09:35:17","modified_gmt":"2024-04-10T09:35:17","slug":"arresting-a-person","status":"publish","type":"topic","link":"https:\/\/www.youthclic.hk\/en\/topic\/our-legal-system\/arresting-procedure-my-rights-and-obligations\/arresting-a-person\/","title":{"rendered":"Arresting a person"},"content":{"rendered":"\n<p>The police may arrest a person according to a warrant issued by a Magistrate under&nbsp;<a target=\"_blank\" href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/227\/s31.html\" rel=\"noreferrer noopener\">Sections 31<\/a>,&nbsp;<a target=\"_blank\" href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/227\/s72.html\" rel=\"noreferrer noopener\">72<\/a>,&nbsp;<a target=\"_blank\" href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/227\/s73.html\" rel=\"noreferrer noopener\">73<\/a>&nbsp;or&nbsp;<a target=\"_blank\" href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/227\/s74.html\" rel=\"noreferrer noopener\">74<\/a>&nbsp;of the&nbsp;<a target=\"_blank\" href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/227\/\" rel=\"noreferrer noopener\">Magistrates Ordinance<\/a>&nbsp;(<a target=\"_blank\" href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/227\/\" rel=\"noreferrer noopener\">Chapter 227<\/a>). For example, an arrest warrant may be issued if an accused person does not appear in Court when he is due to answer a charge.<\/p>\n\n\n\n<p>However, an arrest warrant is not always necessary. Under&nbsp;<a target=\"_blank\" href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/232\/s50.html\" rel=\"noreferrer noopener\">Section 50(1)<\/a>&nbsp;of the&nbsp;<a target=\"_blank\" href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/232\/\" rel=\"noreferrer noopener\">Police Force Ordinance<\/a>&nbsp;(<a target=\"_blank\" href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/232\/\" rel=\"noreferrer noopener\">Chapter 232<\/a>), a police officer can &#8220;apprehend&#8221; (i.e. arrest) a person if he\/she reasonably suspects the person being arrested is guilty of an offence. It is not necessary that the officer knows the exact statutory provision that the suspect has violated, so long as the officer reasonably suspects that the suspect has done something amounting to an offence.<\/p>\n\n\n\n<p>Under&nbsp;<a target=\"_blank\" href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/221\/s101a.html\" rel=\"noreferrer noopener\">Section 101A<\/a>&nbsp;of the&nbsp;<a target=\"_blank\" href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/221\/\" rel=\"noreferrer noopener\">Criminal Procedure Ordinance<\/a>&nbsp;(<a target=\"_blank\" href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/221\/\" rel=\"noreferrer noopener\">Chapter 221<\/a>), any person effecting an arrest may use such force as is reasonable. A police officer may, for example, employ handcuffs or other means of restraint where it is necessary to prevent escape.&nbsp;<a target=\"_blank\" href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/232\/s50.html\" rel=\"noreferrer noopener\">Section 50(2)<\/a>&nbsp;of the&nbsp;<a target=\"_blank\" href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/232\/\" rel=\"noreferrer noopener\">Police Force Ordinance<\/a>&nbsp;(<a target=\"_blank\" href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/232\/\" rel=\"noreferrer noopener\">Chapter 232<\/a>) also allows the police officer to use all means necessary to effect an arrest if the suspect forcibly resists or attempts to evade the arrest.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The police may arrest a person according to a warrant issued by a Magistrate under&nbsp;Sections 31,&nbsp;72,&nbsp;73&nbsp;or&nbsp;74&nbsp;of the&nbsp;Magistrates Ordinance&nbsp;(Chapter 227).
