When a sentence is suspended, the court imposes a prison sentence, but does not order it to take effect immediately. Under\u00a0<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/221\/s109b.html\" target=\"_blank\" rel=\"noreferrer noopener\">section 109B<\/a>\u00a0of the\u00a0<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/221\/\" target=\"_blank\" rel=\"noreferrer noopener\">Criminal Procedure Ordinance<\/a>\u00a0(<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/221\/\" target=\"_blank\" rel=\"noreferrer noopener\">Cap. 221<\/a>), a court which imposes a sentence of not more than two years&#8217; imprisonment may suspend that sentence for a period of not less than one year and not more than three years. The prison sentence is left hanging over the head of the offender for the period of the suspension. A\u00a0<a href=\"http:\/\/youth.clic.org.hk\/usefulInfo\/Punishment-and-sentencing-options\/4\" target=\"_blank\" rel=\"noopener\">suspended sentence<\/a>\u00a0which does not exceed three months; duration can become spent under\u00a0<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/297\/s2.html\" target=\"_blank\" rel=\"noreferrer noopener\">section 2(1)<\/a>\u00a0of the\u00a0<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/297\/\" target=\"_blank\" rel=\"noreferrer noopener\">RHO<\/a>; a longer sentence cannot.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A\u00a0suspended sentence\u00a0is a sentence of imprisonment for the purposes of the\u00a0RHO.
