They are designed to reduce paperwork and expense by allowing police officers and certain other public officers to deal with certain low level anti-social behaviour with on-the-spot penalties. The fixed-penalty notice is not a fine or a criminal conviction.<\/p>\n\n\n\n<p><a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/297\/s2.html\" target=\"_blank\" rel=\"noreferrer noopener\">Section 2(3)<\/a>&nbsp;of the&nbsp;<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/297\/\" target=\"_blank\" rel=\"noreferrer noopener\">Rehabilitation of Offenders Ordinance<\/a>&nbsp;(<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/297\/\" target=\"_blank\" rel=\"noreferrer noopener\">Cap. 297<\/a>) (&#8220;RHO&#8221;) provides that the payment or recovery of a fixed penalty, or any additional penalty, under the&nbsp;<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/237\/\" target=\"_blank\" rel=\"noreferrer noopener\">Fixed Penalty (Traffic Contraventions) Ordinance<\/a>(<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/237\/\" target=\"_blank\" rel=\"noreferrer noopener\">Cap. 237<\/a>), the&nbsp;<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/240\/\" target=\"_blank\" rel=\"noreferrer noopener\">Fixed Penalty (Criminal Proceedings) Ordinance<\/a>&nbsp;(<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/240\/\" target=\"_blank\" rel=\"noreferrer noopener\">Cap. 240<\/a>), the&nbsp;<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/570\/\" target=\"_blank\" rel=\"noreferrer noopener\">Fixed Penalty (Public Cleanliness Offences) Ordinance<\/a>&nbsp;(<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/570\/\" target=\"_blank\" rel=\"noreferrer noopener\">Cap. 570<\/a>), the&nbsp;<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/600\/\" target=\"_blank\" rel=\"noreferrer noopener\">Fixed Penalty (Smoking Offences) Ordinance<\/a>&nbsp;(<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/600\/\" target=\"_blank\" rel=\"noreferrer noopener\">Cap. 600<\/a>) or the<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/611\/\" target=\"_blank\" rel=\"noreferrer noopener\">Motor Vehicle Idling (Fixed Penalty) Ordinance<\/a>&nbsp;(<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/611\/\" target=\"_blank\" rel=\"noreferrer noopener\">Cap. 611<\/a>) is not a conviction for the purposes of&nbsp;<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/297\/s2.html\" target=\"_blank\" rel=\"noreferrer noopener\">section 2(1)<\/a>&nbsp;or<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/297\/s2.html\" target=\"_blank\" rel=\"noreferrer noopener\">2(1A)<\/a>&nbsp;of the&nbsp;<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/297\/\" target=\"_blank\" rel=\"noreferrer noopener\">RHO<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Fixed-penalty notices, for littering or illegal parking, for example, are a fact of contemporary life.
