A spent conviction is a conviction which, under the provisions of the<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/297\/\" target=\"_blank\" rel=\"noreferrer noopener\">Rehabilitation of Offenders Ordinance<\/a>&nbsp;(<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/297\/\" target=\"_blank\" rel=\"noreferrer noopener\">Cap. 297<\/a>) (&#8220;RHO&#8221;), is, subject to some exceptions, ignored after a specified period of time.<\/p>\n\n\n\n<p>The objective of the&nbsp;<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/297\/\" target=\"_blank\" rel=\"noreferrer noopener\">RHO<\/a>&nbsp;is to allow offenders to put a past mistake behind them. When a conviction has become &#8220;spent&#8221;under the&nbsp;<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/297\/\" target=\"_blank\" rel=\"noreferrer noopener\">RHO<\/a>, offenders can, subject to exceptions set out in the&nbsp;<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/297\/\" target=\"_blank\" rel=\"noreferrer noopener\">RHO<\/a>, claim not to have a criminal record, and the spent conviction cannot be held against them.<\/p>\n\n\n\n<p>The &#8220;spent&#8221; conviction provisions of the&nbsp;<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/297\/\" target=\"_blank\" rel=\"noreferrer noopener\">RHO<\/a>&nbsp;are very limited. Under&nbsp;<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/297\/s2.html\" target=\"_blank\" rel=\"noreferrer noopener\">section 2(1)<\/a>&nbsp;of the&nbsp;<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/297\/\" target=\"_blank\" rel=\"noreferrer noopener\">RHO<\/a>, subject to certain exceptions, the conviction of a person who is not sentenced to&nbsp;<a href=\"http:\/\/youth.clic.org.hk\/en\/usefulInfo\/Punishment-and-sentencing-options\/Imprisonment\/\" target=\"_blank\" rel=\"noopener\">imprisonment<\/a>&nbsp;exceeding three months, whether that sentence takes effect immediately or is&nbsp;<a href=\"http:\/\/youth.clic.org.hk\/en\/usefulInfo\/Punishment-and-sentencing-options\/Suspended-sentence\/\" target=\"_blank\" rel=\"noopener\">suspended<\/a>, or to a&nbsp;<a href=\"http:\/\/youth.clic.org.hk\/en\/usefulInfo\/Punishment-and-sentencing-options\/Fine\/#1\" target=\"_blank\" rel=\"noopener\">fine<\/a>&nbsp;exceeding $10,000, and who has not previously been convicted in Hong Kong of any offence will be treated as spent once three years has elapsed without another conviction for an offence in Hong Kong<\/p>\n\n\n\n<p>If a conviction has become spent&nbsp;<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/297\/s2.html\" target=\"_blank\" rel=\"noreferrer noopener\">section 2(1)(c)(i)(ii)(iii)<\/a>&nbsp;of the&nbsp;<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/297\/\" target=\"_blank\" rel=\"noreferrer noopener\">RHO<\/a>&nbsp;provide that, subject to&nbsp;<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/297\/s3.html\" target=\"_blank\" rel=\"noreferrer noopener\">section 3(3) and (4)<\/a>&nbsp;of the&nbsp;<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/297\/\" target=\"_blank\" rel=\"noreferrer noopener\">RHO<\/a>, no evidence about that conviction is admissible in any proceedings. Neither the spent conviction nor any failure to disclose it justifies dismissal or exclusion from any office, profession, occupation or employment or any form of prejudice in that office, profession, occupation or employment.<\/p>\n\n\n\n<p>If an offender is convicted of more than one offence at the same court hearing, the spent conviction provisions in&nbsp;<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/297\/s2.html\" target=\"_blank\" rel=\"noreferrer noopener\">section 2<\/a>&nbsp;of the&nbsp;<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/297\/\" target=\"_blank\" rel=\"noreferrer noopener\">RHO<\/a>&nbsp;still apply, provided the sentence for each offence does not exceed three months&#8217;&nbsp;<a href=\"http:\/\/youth.clic.org.hk\/en\/usefulInfo\/Punishment-and-sentencing-options\/Imprisonment\/\" target=\"_blank\" rel=\"noopener\">imprisonment<\/a>&nbsp;or a&nbsp;<a href=\"http:\/\/youth.clic.org.hk\/en\/usefulInfo\/Punishment-and-sentencing-options\/Fine\/#1\" target=\"_blank\" rel=\"noopener\">fine<\/a>&nbsp;of $10,000. In addition, the aggregate sentence cannot exceed three months&#8217;&nbsp;<a href=\"http:\/\/youth.clic.org.hk\/en\/usefulInfo\/Punishment-and-sentencing-options\/Imprisonment\/\" target=\"_blank\" rel=\"noopener\">imprisonment<\/a>&nbsp;or a&nbsp;<a href=\"http:\/\/youth.clic.org.hk\/en\/usefulInfo\/Punishment-and-sentencing-options\/Fine\/#1\" target=\"_blank\" rel=\"noopener\">fine<\/a>&nbsp;of $10,000, irrespective of whether the sentences run concurrently or consecutively (one after the other).<\/p>\n\n\n\n<p>Where a conviction of an offender has become&#8221;spent&#8221;; under&nbsp;<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/297\/s2.html\" target=\"_blank\" rel=\"noreferrer noopener\">section 2(1)<\/a>&nbsp;of the&nbsp;<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/297\/\" target=\"_blank\" rel=\"noreferrer noopener\">Rehabilitation of Offenders Ordinance<\/a>, the spent conviction continues even if there is a subsequent conviction. However, the subsequent conviction cannot become &#8220;spent&#8221;, because&nbsp;<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/297\/s2.html\" target=\"_blank\" rel=\"noreferrer noopener\">section 2<\/a>&nbsp;of the&nbsp;<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/297\/\" target=\"_blank\" rel=\"noreferrer noopener\">RHO<\/a>&nbsp;applies only if an individual &#8220;has not been convicted in Hong Kong on any earlier day of an offence&#8221;. This clause means that the subsequent conviction cannot become &#8220;spent&#8221;, as it is outside the provisions of&nbsp;<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/297\/s2.html\" target=\"_blank\" rel=\"noreferrer noopener\">section 2<\/a>&nbsp;of the&nbsp;<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/297\/\" target=\"_blank\" rel=\"noreferrer noopener\">RHO<\/a>. The&nbsp;<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/297\/\" target=\"_blank\" rel=\"noreferrer noopener\">RHO<\/a>&nbsp;offers only one opportunity for rehabilitation in respect of the offences covered by&nbsp;<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/297\/s2.html\" target=\"_blank\" rel=\"noreferrer noopener\">section 2<\/a>.
