{"id":583,"date":"2024-04-09T03:41:02","date_gmt":"2024-04-09T03:41:02","guid":{"rendered":"https:\/\/www.youthclic.hk\/topic\/bullying-and-triad-related-crimes-fighting-in-public\/"},"modified":"2024-07-19T09:00:53","modified_gmt":"2024-07-19T09:00:53","slug":"fighting-in-public","status":"publish","type":"topic","link":"https:\/\/www.youthclic.hk\/en\/topic\/bullying-violence-and-gangs\/fighting-in-public\/","title":{"rendered":"Fighting in public"},"content":{"rendered":"<p>Taking part in an unlawful fight in public is an offence, contrary to <a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/245\/s25.html\" target=\"_blank\" rel=\"noopener\">Section 25<\/a> of the <a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/245\/\" target=\"_blank\" rel=\"noopener\">Public Order Ordinance<\/a> (<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/245\/\" target=\"_blank\" rel=\"noopener\">Chapter 245<\/a>).<\/p>\n<p>A &#8220;public place&#8221; is any place to which for the time being the public or any section of the public are entitled or permitted to have access, whether on payment or otherwise.<\/p>\n<p>The word \u201cfight\u201d must be given its ordinary meaning and involves an equality of aggression.<\/p>\n<p>Persons defending themselves against an attack are not in an equality of aggression situation.<\/p>\n<p>It does not matter who started the fight, who won the fight or what it was about provided there is an equality of aggression. Whether there was or was not a fight depends upon all the circumstances of the particular case.<\/p>\n<p>An agreement to fight in public to settle differences does not make the fight lawful.
